By using ElevateX Marketing services, you agree to the following terms.
1. What We Do
ElevateX Marketing provides a missed-call response and lead recovery system designed for plumbing and HVAC businesses.
This may include:
- • Call tracking to monitor incoming and missed calls
- • AI-assisted text responses sent after missed calls
- • Lead tracking and missed-call reporting
- • Customer communication automation related to missed inquiries
This service is designed to help recover missed customer opportunities. It does not replace your phone system, staff, or business operations.
2. The 30-Day Pilot
We may offer a 30-day pilot period to test the system within your business.
- • No upfront payment is required
- • The goal is to measure missed-call recovery opportunities and customer responses
- • Limited setup or integration may be required depending on your business setup
3. Performance-Based Payment
You only pay if the system produces qualifying results.
If we generate 5 or more qualified customer inquiries during the pilot period, your subscription will begin at $297/month after the pilot ends.
If fewer than 5 qualified customer inquiries are generated, you owe $0.
A "qualified customer inquiry" generally means a real person responding through call or text regarding a legitimate service request.
Qualified inquiries are determined based on activity recorded through the system.
4. Billing & Cancellation
- • Billing only begins after the performance condition is met
- • You may cancel at any time
- • If canceled, service will remain active until the end of your current billing period
- • No long-term contracts are required
5. Your Responsibilities
To ensure accurate performance and reporting, you agree to:
- • Keep the system active during the pilot period
- • Avoid removing or interfering with the tracking setup
- • Respond to customer inquiries in a timely manner
- • Provide accurate business information
Note: Failure to follow these responsibilities may impact results and may void the performance condition.
6. No Guarantee of Jobs or Revenue
We help businesses recover missed customer conversations and opportunities.
We do not guarantee:
- • Booked jobs
- • Revenue
- • Specific business outcomes
- • Customer conversion rates
Results depend on factors such as your availability, pricing, service quality, and response time.
7. Service Changes
We may update, improve, modify, or discontinue parts of the service at any time to improve functionality or performance.
8. Limitation of Liability
ElevateX Marketing is not responsible for:
- • Lost jobs or revenue
- • Missed opportunities outside the system
- • Customer decisions or behavior
- • Technical outages or issues beyond our control
9. Termination
We reserve the right to suspend or terminate service if:
- • The system is misused
- • Payments are not made after qualification
- • The service is used in violation of applicable laws
- • Activity harms customers, businesses, or system integrity
10. Communication
You agree that we may contact you via phone, SMS, or email regarding your account, pilot results, services, or support-related communication.
